A request to set up a mechanism to examine the requests of Palestinian students from the Gaza Strip seeking to attend higher education institutions in the West Bank
Gisha attorney Itamar Inbari has written to Ruth Bar, Assistant to the Defense Minister, with a request to set up a mechanism that would examine requests by Palestinian students from the Gaza Strip seeking to attend higher education institutions in the West Bank, on a case by case basis. A ruling handed down by the High Court of Justice in petition no. 11120/05, Hamdan vs. GOC Southern Command, contained a recommendation by Justice Rubinstein to set up a mechanism of this kind to allow Gaza students to study in the West Bank. Despite the fact the ruling was handed down on August 7, 2007, no such mechanism has been created, and Gaza students are effectively barred from studying in the West Bank. Gisha argues that setting up a case-by-case mechanism would be a natural step, considering the recent changes in Israeli policy regarding the movement of individuals from Gaza to the West Bank in the past few months.
